2. Subscription and Payment

Our Service is offered on a subscription basis. You will be billed in advance on a recurring basis, depending on the subscription plan you select. We offer monthly and annual billing cycles.

You may cancel your subscription at any time. If you cancel, you will continue to have access to the Service until the end of your billing period, but you will not receive a refund for the current billing period.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

3. Store Integration and Data Usage

Our Service requires integration with your e-commerce store (such as Shopify) and third-party email marketing platforms (such as Klaviyo). By connecting your store to our Service, you grant us permission to:

  • Access and process your store data, including product information, customer data, and order history

  • Generate email marketing content and campaigns based on your store data

  • Push content and campaigns to your connected email marketing platform

You represent and warrant that you have all necessary rights and permissions to share such data with us, and that our use of such data as contemplated by these Terms does not violate any applicable laws or agreements.

4. AI-Generated Content

While we strive to provide accurate and high-quality AI-generated email content, we cannot guarantee the accuracy, quality, or suitability of the content for any specific purpose. We shall not be held liable for any errors, inaccuracies, or issues that may arise from the use of the AI-generated content provided by our Service.

You agree to review and approve all AI-generated content before sending it to your customers. You are solely responsible for all communications sent to your customers through our Service.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of JetFlow and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JetFlow.

You retain all rights to your store data, customer information, and brand assets that you upload or provide to the Service. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing the Service to you.

6. User Content and Conduct

You are responsible for all content that you provide, create, or modify through our Service, including email copy, subject lines, images, and other marketing materials. You agree not to use our Service to create or distribute:

  • Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of privacy

  • Content that infringes upon intellectual property rights of third parties

  • Spam, unsolicited mass emails, or communications that violate anti-spam laws (such as CAN-SPAM, CASL, or GDPR)

  • Content that promotes discrimination, bigotry, racism, hatred, or physical harm against any group or individual

  • Content that is false, deceptive, or misleading

7. Compliance with Email Marketing Laws

You acknowledge and agree that you are solely responsible for ensuring that all email marketing campaigns created and distributed through our Service comply with all applicable laws and regulations, including but not limited to CAN-SPAM (United States), CASL (Canada), GDPR (European Union), and other applicable privacy and electronic communication laws.

This includes, but is not limited to:

  • Obtaining proper consent from recipients before sending marketing communications

  • Including accurate sender information

  • Providing clear and conspicuous unsubscribe mechanisms

  • Honoring opt-out requests promptly

  • Only sending to recipients who have not opted out

Our Service integrates with third-party services, including Shopify, Klaviyo, and others. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, policies, or content of these third-party services.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. 10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact our support team to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You agree to defend, indemnify, and hold harmless JetFlow, its affiliates, and their respective directors, officers, employees, contractors, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from:

  • Your use of our Service

  • Your violation of these Terms

  • Your violation of any rights of another person or entity

  • Your violation of any applicable laws, rules, or regulations

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JetFlow, its affiliates, directors, employees, partners, agents, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, JetFlow assumes no liability or responsibility for:

  • Any errors, mistakes, or inaccuracies in content generated by our Service

  • Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Service

  • Any unauthorized access to or use of our secure servers and/or any personal information stored therein

  • Any interruption or cessation of transmission to or from the Service

  • Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service

  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.   • Any errors or defects will be corrected

  • The Service is free of viruses or other harmful components

  • The results of using the Service will meet your requirements

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
